1. Agreement to Terms
By accessing or using the Capsule Media Group website and services ("Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our Services.
2. Services
Capsule Media Group provides business consulting, marketing setup, operations tool configuration, and ongoing support services. The specific scope of services will be outlined in individual service agreements between Capsule Media Group and the client.
3. Eligibility
You must be at least 18 years of age and capable of entering into a legally binding agreement to use our Services. By using our Services, you represent and warrant that you meet these requirements.
4. Contact Information & Communications
When you provide your contact information through our forms, you agree that the information is accurate and current. We may use the information you provide to contact you regarding our Services via the channels you have consented to.
5. SMS/Text Messaging Terms
The following terms govern the Capsule Media Group SMS/text messaging program ("SMS Program"). By opting in, you agree to all terms in this section. Please read carefully.
5.1 Program Description
The Capsule Media Group SMS Program sends recurring automated text messages to opted-in users. Messages may include, but are not limited to:
- Appointment and consultation reminders
- Service updates and project status notifications
- Promotional offers and special deals
- Account-related alerts
- Follow-up communications regarding your inquiry
- General business-related informational messages
5.2 Consent & Authorization
By checking the SMS opt-in checkbox on our website and providing your mobile phone number, you expressly consent to receive recurring automated marketing and informational text messages from Capsule Media Group at the mobile phone number you provided. You acknowledge that:
- Your consent is being provided voluntarily and is not coerced.
- You authorize Capsule Media Group and its SMS service providers to use an automatic telephone dialing system (ATDS), autodialer, or other automated technology to send text messages to the mobile phone number you provided, even if your phone number is registered on any state or federal do-not-call list.
- You are the owner or authorized user of the mobile device and phone number you provide.
- You are at least 18 years of age.
- Your consent to receive SMS messages is NOT a condition of purchasing any goods or services from Capsule Media Group. You are not required to opt in to SMS to receive our services, make a purchase, or engage with our company in any way.
5.3 Message Frequency
Message frequency varies based on your interactions, the services you have engaged with, and ongoing campaigns. Typically, you may receive between 2–10 messages per month. During active onboarding or promotional periods, frequency may increase temporarily. We will never send messages at unreasonable hours (messages are sent between 9:00 AM and 8:00 PM in your local time zone).
5.4 Message & Data Rates
Standard message and data rates may apply to any messages sent or received, depending on your mobile carrier plan. Capsule Media Group is not responsible for any charges imposed by your mobile carrier, including but not limited to messaging fees, data overage charges, or roaming charges. Contact your mobile carrier for pricing details.
5.5 Opt-Out / How to Stop Messages
You may revoke your consent and opt out of receiving SMS messages at any time by using any of the following methods:
- Reply STOP: Text the word STOP to any message you receive from us. You will receive a single confirmation message confirming your opt-out. No additional messages will be sent unless you re-subscribe.
- Reply CANCEL, UNSUBSCRIBE, QUIT, or END: Any of these keywords will also opt you out of the SMS Program.
- Email: Contact us at sms@capsulemediagroup.com with the subject line "SMS Opt-Out" and include the phone number you wish to unsubscribe.
After opting out, you will no longer receive text messages from Capsule Media Group unless you explicitly re-subscribe. Please allow up to 48 hours for opt-out processing. Opting out of SMS does not affect any other communications you may receive from us (such as email).
5.6 How to Get Help
For assistance with the SMS Program at any time:
- Reply HELP: Text the word HELP to any message you receive from us for assistance.

- Phone: Contact us using the information in the Contact Us section below.
5.7 Re-Subscribing
If you previously opted out and wish to re-subscribe to our SMS Program, you may do so by completing a new opt-in through our website at capsulemediagroup.com, or by contacting us at sms@capsulemediagroup.com to request re-enrollment. A new opt-in consent will be required.
5.8 Supported Carriers
Our SMS Program is supported on all major US mobile carriers, including but not limited to: AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, Boost Mobile, Cricket Wireless, MetroPCS, Google Fi, Mint Mobile, Visible, and other regional carriers. However, not all carriers guarantee delivery of all message types. Carriers are not liable for delayed or undelivered messages. Capsule Media Group is not responsible for messages that are not delivered due to carrier network issues, device incompatibility, or other factors outside our control.
5.9 No Sharing of Opt-In Data
We do not sell, rent, lease, or share your phone number, SMS opt-in consent, or any information collected through our SMS Program with any third parties or affiliates for their own marketing or promotional purposes. Your opt-in data is only shared with our SMS service provider(s) solely for the purpose of delivering text messages on our behalf, as described in our Privacy Policy.
5.10 TCPA Compliance
Our SMS Program is operated in compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and all applicable Federal Communications Commission (FCC) regulations governing automated text messages and telemarketing. We maintain records of opt-in consent, opt-out requests, and message delivery as required by law.
5.11 E-SIGN Disclosure
By providing your consent to receive SMS messages, you agree to receive communications electronically in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.). Your electronic consent to this SMS Program is legally binding and has the same force and effect as a written signature.
5.12 Disclaimer & Limitation of Liability for SMS
Capsule Media Group makes no warranties, express or implied, regarding the SMS Program, including but not limited to the availability, timeliness, or accuracy of text messages. To the maximum extent permitted by applicable law, Capsule Media Group, its affiliates, and its SMS service providers shall not be liable for any damages, losses, or costs arising from or related to the SMS Program, including but not limited to:
- Failed, delayed, or misdirected text messages
- Carrier charges or data fees incurred by you
- Any action taken or not taken in reliance on information sent via text message
- Any unauthorized access to or alteration of your transmissions or data
5.13 Dispute Resolution for SMS Program
Any disputes arising out of or related to the SMS Program shall be resolved in accordance with the Governing Law and Dispute Resolution provisions of these Terms (see Section 10 below). You agree to attempt to resolve any dispute informally by contacting us at legal@capsulemediagroup.com before pursuing any formal legal action.
5.14 Changes to SMS Terms
We reserve the right to modify the terms of our SMS Program at any time. Material changes will be communicated via text message to active subscribers and/or posted on this page. Your continued participation in the SMS Program after changes are posted constitutes acceptance of the updated terms. If you do not agree with any changes, you may opt out at any time by replying STOP.
6. Intellectual Property
All content on this website, including text, graphics, logos, and software, is the property of Capsule Media Group or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
7. Limitation of Liability
To the fullest extent permitted by law, Capsule Media Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use our Services.
8. Disclaimer of Warranties
Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that our Services will be uninterrupted, error-free, or secure.
9. Indemnification
You agree to indemnify, defend, and hold harmless Capsule Media Group, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of our Services or violation of these Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.
